The General Terms and Conditions (hereinafter referred to as "GTC") apply to all legal transactions concluded via the online store www.brunaschoice.com (hereinafter referred to as "online store"). Bruna's Choice reserves the right to amend these GTC at any time. The version of these GTC in force at the time of the order shall apply. For all product orders with a minimum age requirement of 18 years, the customer confirms compliance with these legal provisions when placing the order. Orders in quantities not customary for households may be rejected without justification.
General Information
Images of products in advertising, brochures, online store, etc. are for illustrative purposes only and are non-binding. All sales prices published in the online store are final prices that include all taxes, costs for packaging, delivery costs and all other possible charges, fees or costs.
Bruna's Choice attaches great importance to providing up-to-date and accurate information on availability and delivery times in the online store. However, there may be delays in delivery, particularly due to production or delivery bottlenecks. All information on availability and delivery times is without guarantee and may change at any time.
Contract
The products are always subject to the condition that the contract is dissolved if delivery is not possible or if the price is incorrect. The purchase contract for Bruna's Chocie products or services is concluded as soon as the customer places their order in the online store, by telephone or e-mail (hereinafter referred to as the "purchase contract"). The arrival of an online order is indicated to the customer by means of an automatically generated order confirmation sent by Bruna's Choice to the e-mail address provided by the customer. The receipt indicates to the customer that the order placed has been received by the online store and that the contract with Bruna's Choice has therefore been concluded subject to delivery availability and correct pricing.
Delivery
The customer has the right to withdraw from the contract from the 30th calendar day after the originally announced delivery date. In this case, Bruna's Choice shall reimburse the customer for any amounts already paid in advance. There are no further claims against Bruna's Choice. Bruna's Choice products and services can only be delivered to customers by post (see on "Deliveris and returns" page). If the customer does not accept the ordered products on the agreed or indicated delivery date, Bruna's Choice may terminate (cancel) the contract and charge the customer for the delivery costs incurred and any loss of value.
Obligation to inspect recevied products
Customers must immediately check delivered or collected products for correctness, completeness and delivery damage. Delivery damage, incorrect and incomplete deliveries must be reported to Bruna's Choice within 5 calendar days from the time of delivery, including for all products and services of a retailer. The customer is aware that such a report must be made via the online store's contact form. The customer may not put such a product into operation. They must keep it as received in its original packaging and follow the instructions of the Bruna's Choice team.
Warranty
Bruna's Choice guarantees the ordered product to be free of defects for 2 years after delivery or store collection, provided that the instructions for use are complied with. Bruna's Choice can provide the warranty as follows:
- partial or complete replacement with an equivalent used product.
- replacement with a new product by Bruna's Choice (new warranty period of 2 years from replacement)
- credit note at the current price, (maximum the sales price at the time of the order)
Wear parts are excluded from the warranty.
Liability
Liability is governed by the applicable statutory provisions. However, in no event shall Bruna's Choice be liable for (i) slight negligence, (ii) indirect and consequential damages and lost profits, (iii) unrealized savings, (iv) damages resulting from delay in delivery, and (v) any acts and omissions of Bruna's Choice's auxiliary persons, whether contractual or non-contractual. Bruna's Choice disclaims, without limitation, all liability for any loss or damage of any kind, including any direct, indirect or consequential damages, which might be incurred through the use of or access to the Bruna's Choice website, or any links to third-party websites. Bruna's Choice does not guarantee that the individual parts of its website will function without error.
Modification of the order or cancellation
Orders obligate the customer to accept the products. Changes or cancellations to orders placed by the customer , Bruna's Choice can charge a handling fee of 20% of the canceled order value, but at least CHF 30, as well as any loss in value of the canceled products since they were ordered.
Place of jurisdiction and applicable law
All legal relationships between Bruna's Choice and the customer are subject to Swiss substantive law. The Vienna Sales Convention is not applicable.
Changes to this Notice
We may update this notice from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons.
